1. Introduction
This document sets out the General Terms and Conditions (hereinafter, "T&C") under which users of the OlaCar platform, operated by OlaCar LLC, access and use the peer-to-peer vehicle rental services available at olacar.app.
OlaCar acts exclusively as a technological intermediary between Hosts (vehicle owners) and Drivers (persons who rent the vehicle). OlaCar does not own the vehicles listed on the Platform, nor is it a party to the rental contract between Host and Driver.
By registering on the Platform and by making or accepting a booking, the user agrees to be legally bound by these T&C, the Privacy Policy and the other policies published on the Platform.
2. Definitions
For the purposes of these T&C, the following terms shall mean:
- Platform: the OlaCar digital platform accessible at olacar.app and all associated technological tools.
- OlaCar / the Company: OlaCar LLC, a company incorporated in the United States of America.
- Host: a natural or legal person who lists one or more vehicles for rental through the Platform.
- Driver: a natural person who books and uses a vehicle listed by a Host through the Platform.
- Additional Driver: a person expressly authorized by OlaCar to drive the vehicle within the framework of an active booking, in addition to the Main Driver.
- Main Driver: the Driver who made and paid for the booking.
- OlaGo!: telematics and vehicle identification device owned by OlaCar, installed in the vehicles listed on the Platform.
- Booking: a confirmed agreement between Host and Driver through the Platform for the rental of a vehicle for a specified period.
- SURA: the insurance company that provides the coverage policy applicable to the rentals carried out through the Platform.
- U.R.: Unidad Reajustable (Indexed Unit), a unit of value measurement established by Uruguayan legislation.
3. Participating parties and legal entities
The Platform is operated by OlaCar LLC. In Uruguay, operations are managed by Loiroma SAS. By using the Platform, the user contracts with both entities jointly for the purposes of this agreement.
The law applicable to these T&C is that of the Eastern Republic of Uruguay. Any dispute arising from the use of the Platform shall be submitted to the Ordinary Courts of the Department of Montevideo.
4. Registration and requirements for drivers
To register as a Driver on the Platform, the user must meet the following requirements:
- Be over 18 years of age.
- Hold a valid driver's license with at least one year of seniority. In the case of foreign drivers, a valid international license is required, with the Driver being responsible for its authenticity.
- Complete the identity verification process on the Platform, which includes a photograph of the identity card or equivalent document, a selfie holding the document, and a biometric verification video.
- Have a valid payment method registered on the Platform.
OlaCar reserves the right to reject, suspend or cancel Driver accounts when the data provided cannot be confirmed or when false, inaccurate or fraudulent information is detected. OlaCar may assess the applicant's risk through internal verification mechanisms or authorized third parties.
5. Requirements for hosts and vehicle conditions
To list a vehicle on the Platform, the Host must:
- Be the owner of the vehicle or have express authorization from the owner to make it available for rental.
- Guarantee that the vehicle is not subject to seizure, pledge, injunction, sale notice, or any measure that affects its free availability.
- Guarantee that the vehicle has no outstanding traffic fines, license plate fees, taxes or other enforceable obligations.
5.1 Maximum vehicle age
By requirement of the insurance policy contracted with SURA, only vehicles with a maximum age of 10 years from the year of manufacture may be listed on the Platform. OlaCar reserves the right to remove any vehicle that exceeds this limit, without this giving rise to any right to compensation for the Host.
5.2 Technical inspection and mandatory maintenance
The Host must keep the vehicle in optimal mechanical condition and provide evidence of such maintenance to OlaCar. To do so, the Host must:
- Send the receipt for the most recent service performed to WhatsApp 091 872 872 at the time of registering the vehicle on the Platform.
- Carry out maintenance services every 10.000 km or as recommended by the manufacturer, whichever occurs first, and send the corresponding receipt to OlaCar each time it is performed.
If the Host cannot prove that maintenance is up to date at the time a mechanical failure occurs during a rental, the failure shall be presumed to be attributable to lack of maintenance, and the Driver's version shall take priority in the resolution of the claim. In that case, the assistance and repair costs shall be borne by the Host.
5.3 Listing conditions
When listing a vehicle on the Platform, the Host declares and warrants that the vehicle:
- Is in perfect mechanical and structural condition, suitable to be driven safely by a third party.
- Has received adequate maintenance in accordance with the manufacturer's recommendations.
- Has no known defects at the time of listing.
- Has documentation in order, including the vehicle registration card, a valid SOA policy, mandatory technical inspection (where applicable) and all documentation required for circulation.
- Has at least two sets of keys in usable condition.
6. OlaGo! device and theft coverage
Every vehicle listed on the Platform may have the OlaGo! telematics and remote access device by OlaCar installed.
Coverage for theft or robbery of the vehicle is conditional on the OlaGo! device being installed, active and functioning correctly at the time of the incident. If the device is uninstalled, damaged, tampered with or inactive due to causes attributable to the Host, theft coverage shall be excluded for that event.
For the other coverages provided under the policy with SURA (partial damage, civil liability, etc.), the presence of the OlaGo! is not an excluding requirement, unless the policy itself establishes additional conditions.
The Host may not remove, disconnect or interfere with the operation of the OlaGo! device without authorization from OlaCar. Any unauthorized intervention shall be considered a serious breach of these T&C and may result in the immediate suspension of the account and the removal of the listed vehicles.
7. Vehicle data processing and telematics consent
In compliance with Law No. 18.331 on the Protection of Personal Data of the Eastern Republic of Uruguay, OlaCar informs that the OlaGo! device installed in each vehicle collects operating data continuously during rentals. This data may include, among others: real-time location, speed, acceleration, mileage traveled, fuel level, ignition status and technical diagnostics of the vehicle ("Vehicle Data").
By accepting these T&C, both the Host and the Driver give their express, free and informed consent to the collection, storage and use of the Vehicle Data by OlaCar for the following purposes:
- Verify the correct use of the vehicle during the rental.
- Manage incidents, disputes and claims between the parties.
- Ensure the validity and applicability of the insurance coverage.
- Improve the experience and safety of the Platform.
The Vehicle Data shall not be transferred to third parties except where necessary for the management of the insurance with SURA, compliance with a court order, or the protection of the rights of the parties involved in an incident.
The Driver must inform their companions that the vehicle has this monitoring system active throughout the entire duration of the rental.
8. Booking process
To make a booking, the Driver must select the vehicle of their preference using the filters available on the Platform (area, vehicle type, rental dates and pick-up and return arrangements).
Once the request is sent, the Host has up to 8 hours to accept or reject it. Once the booking is accepted, OlaCar will process the corresponding charge and put both parties in contact to coordinate the handover.
All agreements relating to the rental — including term extensions, changes to the pick-up or return location, price modifications and any other adjustment — must be managed exclusively through the Platform. Agreements made outside the Platform, whether verbally, by text message or by other means, shall not be recognized or supported by OlaCar and shall not give rise to rights or obligations for either party vis-à-vis the Company.
9. Additional driver
The vehicle may only be driven by the Main Driver who made the booking, unless an Additional Driver has been registered and validated before the start of the rental.
To enable an Additional Driver, the Main Driver must:
- Send a written request via WhatsApp to 091 872 872, indicating the full name, surname and identity card number of the proposed additional driver.
- The proposed additional driver must have an account created and validated on the Platform, meeting the same requirements demanded of any driver.
- OlaCar will confirm the authorization in writing. Without this confirmation, the additional driver shall not be authorized to drive the vehicle under any circumstances.
If it is proven that an unauthorized person drove the vehicle, a fine of UYU 2.000 shall be applied to the Main Driver, the insurance coverage shall be rendered void for any incident occurring during that period, and the Main Driver shall assume full responsibility for the damages caused. OlaCar is authorized to execute the charge against the payment method registered for the booking.
10. Vehicle handover and return
The Host must hand over the vehicle to the Driver at the place, date and time agreed in the booking, together with:
- One set of vehicle keys.
- A copy or original of the vehicle registration card.
- A copy of the valid SOA insurance policy.
- First-aid kit, regulation warning triangle, spare wheel, jack and a one-kilo tri-class fire extinguisher, in accordance with Uruguayan regulations.
The Host must hand over the vehicle with a full fuel tank. The Driver must return it in the same condition.
The Driver must present their identity card and valid driver's license at the time of picking up the vehicle. The Host may refuse to hand over the vehicle if the Driver does not meet these requirements, is not the person identified in the booking, or shows signs of not being in a condition to drive.
10.1 Mandatory photographic record
At the start of each rental, the Driver must complete the photographic record of the vehicle following the flow guided by the Platform, which covers all angles of the vehicle. This record has evidentiary value for determining the condition of the vehicle before the rental.
If the Driver does not complete the photographic record at the start, a fine of UYU 500 shall be applied and the vehicle shall be presumed to have been handed over without visible damage. In the event of any subsequent dispute, the Driver may not claim pre-existing damage.
At the end of the rental, the Host must complete the same record within 24 hours of the return. If the Host fails to do so within that period, they shall lose the right to claim damages for that rental.
11. Cancellations
11.1 Cancellation by the Driver
The Driver may cancel a booking without penalty up to 72 hours before the start of the rental. Cancellations made less than 72 hours in advance shall incur a charge of UYU 2.000 in favor of the Host.
If the Driver does not show up without having previously cancelled (no-show), 100% of the booking value shall be charged with no right to a refund.
11.2 Cancellation by the Host
If the Host cancels a booking less than 24 hours in advance, a charge of UYU 2.000 shall be applied. If the Host fails to hand over the vehicle under the agreed conditions without just cause, they must pay the Driver the equivalent of 50% of the total booking value.
In the event of cancellation by the Host, OlaCar will offer the Driver, subject to availability, an alternative vehicle of similar characteristics or the full refund of the amount paid.
12. Commissions
OlaCar receives the following commissions for intermediation, use of the technology and operational support:
- Driver: 10% of the rental value + UYU 200 per day for insurance.
- Host: 15% of the rental value + UYU 150 per day for insurance.
These commissions shall be automatically deducted at the time of settlement of each booking. OlaCar reserves the right to modify the commissions with prior notice to users through the Platform.
12.1. Book now, pay later
When the Host enables pay-at-pickup ("Book now, pay later"), the Driver pays online at booking time the full OlaCar fees and insurance (both Driver-side and Host-side) plus the security deposit. At vehicle pickup the Driver pays the Host directly only the Host's net amount, per the agreed payment instructions. OlaCar does not transfer that amount to the Host, since the Host receives it directly.
13. Insurance and coverage
Rentals carried out through the Platform are covered by an insurance policy contracted by OlaCar with SURA. OlaCar is not an insurance company and does not directly insure Hosts or Drivers.
The policy covers rentals exclusively during the active period registered on the Platform, and provided that the Driver has complied with these T&C. Breach of the T&C — including the use of the vehicle for paid transport services, driving under the influence of alcohol or substances, or transfer to unauthorized drivers — shall automatically void the coverage.
14. Mechanical failures and roadside assistance
If the vehicle has a mechanical failure during the rental, the Driver must:
- Stop the vehicle in a safe place.
- Contact the Host immediately to report the situation.
- If the Host does not respond or cannot resolve the situation within a reasonable period, contact OlaCar via WhatsApp 091 872 872.
OlaCar will coordinate roadside assistance. The cost shall be assigned according to the cause of the failure:
If the failure is the responsibility of the Host — due to normal wear, lack of maintenance or pre-existing problems not reported — the cost of assistance and repair shall be borne by the Host. OlaCar may deduct said amount from future settlements.
If the failure is the responsibility of the Driver — due to proven misuse of the vehicle — the cost shall be borne by the Driver. OlaCar is expressly authorized to execute the charge directly against the payment method registered for the booking, without the need for additional authorization.
The following are considered signs of misuse of the vehicle by the Driver, among others: ignoring dashboard warnings, use of incorrect fuel, abusive driving or repeated sudden accelerations, overloading of passengers or cargo, and failing to report a failure in time, thereby aggravating the damage.
In the event of a dispute over the cause of the failure, OlaCar may require an independent technical diagnosis before assigning the charge. OlaCar's decision shall be binding on both parties, without prejudice to the right of each party to challenge it through the appropriate legal channels.
The Driver may not carry out repairs on their own account without prior authorization from the Host and OlaCar. Unauthorized expenses shall not be recognized by either party.
15. Vehicle use conditions
The Driver undertakes to use the vehicle responsibly and in accordance with Uruguayan traffic regulations. The following are expressly prohibited:
- Allowing persons not authorized by OlaCar to drive the vehicle.
- Smoking inside the vehicle.
- Transporting animals without express authorization from the Host.
- Using the vehicle to participate in competitions, races or activities that involve extreme use.
- Transporting illegal, dangerous or flammable substances.
- Driving under the influence of alcohol, drugs, medication or any substance that affects the ability to drive.
- Making modifications to the vehicle without authorization from the Host.
- Using the vehicle to tow other vehicles or loads.
- Overloading the vehicle beyond its official passenger or cargo capacity.
15.1 Prohibition of use for paid transport
It is expressly prohibited to use the vehicle rented through OlaCar to provide paid passenger transport services through intermediation platforms or applications, including but not limited to Uber, Cabify, DiDi, InDrive or any similar service.
Breach of this prohibition shall have the following consequences: immediate cancellation of the rental, total loss of the insurance coverage, suspension or permanent cancellation of the Driver's account, and the Driver's liability for all damages caused to the vehicle, to third parties and to the Host, without limit. OlaCar shall be authorized to execute the charge for the damages against the registered payment method.
16. Fines and charges for breach
OlaCar may apply the following charges to the Driver or the Host as appropriate. All amounts shall be automatically debited from the payment method registered on the Platform. An additional 10% shall be applied to the total of each charge for administrative costs in favor of OlaCar.

(*) The amount claimed by the Host for missing fuel shall be taken as valid, provided that the claim is submitted within 2 hours of the return of the vehicle with photographic evidence of the fuel level.
In the event of a discrepancy over any charge, the parties may submit their objection to OlaCar within 48 hours of being notified of it.
17. Reporting of incidents and accidents
Any incident occurring during the rental — accident, damage, theft, or any event that affects the integrity of the vehicle or of third parties — must be reported immediately via WhatsApp 091 872 872. OlaCar will guide the Driver through the steps to follow, including coordination with SURA Seguros where applicable.
In the event of an accident involving third parties, the Driver must collect the third party's details: first and last name, contact number, vehicle license plate and insurance policy number. Failure to provide this information may prevent the waiver of the deductible.
The Host shall have a period of 24 hours from the return of the vehicle to report damage not reported by the Driver. Once this period has expired, they may not claim for such damage.
OlaCar will work with SURA and the workshops in the official network to manage repairs. No specific repair timeframes are guaranteed, as these may depend on external factors such as the availability of parts.
17.1 Administrative incident management fee
For each reported incident that requires active management by OlaCar, an administrative fee shall be applied to the Driver according to the magnitude of the damage, in accordance with the table of charges in Clause 16.
18. Tolls and traffic fines
The Driver is responsible for all tolls and traffic fines incurred during the rental period. If the vehicle records fines or toll debts, the Host may report them to OlaCar within 2 months of their publication in SUCIVE. OlaCar will manage the charge to the Driver through the registered payment method.
The charge for fines shall include the value of the fine plus an administrative charge of 10% in favor of OlaCar. The charge for tolls shall include the value of the toll plus an administrative charge of UYU 100.
19. Host listings and special conditions
The Host may establish special conditions for rentals, provided that they do not contradict these T&C nor constitute unjustified discrimination contrary to the law. By way of example, the Host may establish that the vehicle does not allow pets, smokers or other reasonable conditions.
Breach of the special conditions established by the Host shall give rise to a fine of 2 U.R. to the Driver, plus the 10% administrative charge.
20. Ratings
At the end of each rental, Drivers and Hosts may rate each other. Ratings are public and form part of each user's profile. OlaCar reserves the right to edit or delete ratings that are considered inappropriate, offensive or fraudulent, and to suspend or remove accounts that accumulate repeated negative ratings.
21. Emergency contact and support
In the event of any accident, incident, mechanical failure or emergency during the rental, the Driver must contact OlaCar as a first step via WhatsApp at the number 091 872 872, available 24 hours a day, 7 days a week. OlaCar will guide the Driver through the steps to follow, including coordination with SURA Seguros where applicable.
The number 091 872 872 operates exclusively via WhatsApp and does not handle phone calls. All communication must be carried out in writing through that channel in order to leave a record of the incident.
For direct insurance assistance, SURA can be contacted at 0800 8120 ext. 1 from Uruguay, available 24 hours a day.
22. Protection of personal data
OlaCar processes the personal data of its users in accordance with Law No. 18.331 on the Protection of Personal Data of Uruguay and its implementing decree. The data collected shall be used exclusively for the management of the account, the provision of the services, the management of the insurance with SURA and compliance with legal obligations.
OlaCar shall not transfer personal data to third parties except those mentioned in the previous paragraph or when required by court order. The user may exercise their rights of access, rectification, updating and deletion of data through the Platform's support channels.
23. Limitation of liability
OlaCar acts exclusively as a technological intermediary and is not a party to the rental contract between Host and Driver. OlaCar does not guarantee the identity, solvency, conduct or legal capacity of users, nor the veracity of the information they publish on the Platform.
Under no circumstances shall OlaCar be liable for indirect damages, loss of profits, loss of data or any other harm arising from the use of the Platform or from the rentals arranged through it, except in cases of willful misconduct or gross negligence directly attributable to OlaCar.
OlaCar's maximum liability to any user, for any cause, is limited to the amount of the commission received on the booking that gave rise to the claim.
24. Modification of the Terms and Conditions
OlaCar reserves the right to modify these T&C at any time. Modifications shall be notified to users through the Platform at least 7 days in advance before they take effect. Continued use of the Platform after notification implies acceptance of the new T&C.
25. Jurisdiction and applicable law
These T&C are governed by the laws of the Eastern Republic of Uruguay. For any dispute arising from the use of the Platform, the parties agree to submit to the exclusive jurisdiction of the Ordinary Courts of the Department of Montevideo, waiving any other jurisdiction that might apply to them.
